NOTICE OF PUBLIC HEARING
BY THE NEVADA CITY PLANNING COMMISSION

TO CONSIDER AN ANNEXATION PROPOSAL BY THE COUNTY OF NEVADA FOR THE CITY OF NEVADA CITY TO ANNEX  43.5 ACRES  INTO THE CITY LIMITS OF NEVADA CITY AND TO CONSIDER THE PREZONE OF THOSE PROPERTIES

NOTICE IS HEREBY GIVEN that on Thursday, May 19, 2022 at 1:30 p.m. or as soon thereafter as the matter may be heard, the Nevada City Planning Commission will hold a public hearing at City Hall, 317 Broad Street, Nevada City, California to consider a annexation of approximately 43.5 acres and pre-zoning for the following properties within the City’s Sphere of Influence (SOI):

  • Area A (Approx. 38 acres):  Three County-owned parcels on State Highway 49, including the County Juvenile Hall, which is currently connected to City sewer, and two adjacent and vacant County-owned properties including a future lease site for Tahoe National Forest Headquarters.Annexation Area A also includes the Right-of-Way on State Highway 49 along the frontage of the three County-owned parcels.

    Area B (Approx 5.5 acres): Three private residential properties and two City-owned parcels on Old Downieville Highway.Three residential properties are and one residential property is currently served by City sewer. Annexation Area B also includes the Right-of-Way of Old Downieville Highway and Champion Road along the frontage of the three residential parcels and two City-owned parcels

Staff is recommending that the pre-zoning of these projects be found exempt under Section 15061(b) (3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.  The pre-zoning will provide land use designations that are either compatible with existing developed uses or compatible with the Nevada City General Plan Land Use Designations and the planned use of the properties to be annexed; 

NOTICE IS FURTHER GIVEN that written comments may be filed with the City Planner during regular working hours at City Hall prior to said hearing.  Comments can be submitted to 317 Broad Street, Nevada City, CA 95959 or via email at [email protected].  A copy of the complete application is on file and is available for inspection at City Hall and the Staff Report is available for review at the City’s website at www.nevadacityca.gov on the Agendas and Minutes page or at City Hall.  

IF YOU CHALLENGE the Commission’s decision on this matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the City Planner at or prior to the hearing.
