On April 12, 2017 the City Council adopted Ordinance No. 2017-06, and on June 28, 2017 the City Council adopted Ordinance No. 2017-10, repealed and re-enacted by Ordinance No. 2018-10 which established regulations for permitting and operating cannabis businesses.

TO CONSIDER AN AMENDED CANNABIS BUSINESS APPLICATION
AT 138 NEW MOHAWK ROAD, FOR EMERALD BAY WELLNESS
NOTICE IS HEREBY GIVEN that on Thursday, June 15, 2023 at 1:30 p.m., or as soon thereafter as the matter may be heard, the Planning Commission of Nevada City will hold a public meeting at City Hall, 317 Broad Street, Nevada City, California to consider an amended cannabis business application by the following applicant, within an existing building as follows:
- Emerald Bay Wellness their business by approximately 895 square feet . Their current operation is authorized to operate a Distribution and Manufacturing facility using non-volatile solvents. According to the amendment request, all processes and equipment are remaining the same; Just the layout of the space is changing. Section 9.22.090(Q) of the City Municipal Code allows for administrative approval of expansions up to 25% or 250 sq feet, whichever is smaller. The applicant’s request to expand by 895 square feet exceeds the threshold for administrative review and therefore will need to be reviewed by the Planning Commission. The applicant has also requested to change their license type from medical-only to also allow adult-use.
