Onyx Theater Remodel and Expansion Project

PROJECT:     Application to the Planning Commission for a Conditional Use Permit to remodel the Onyx Theater, located at 103 and 107 Argall Way and expand into existing space, as well as enclose the existing alley between the two buildings. The existing stone wainscoting would be removed and existing windows would be replaced with fiberglass windows    The remodeled building will feature painted cement plaster and metal siding, and will feature patterned metal panels for railings and privacy screens. The proposal includes 422 square feet of outdoor lounge seating, which may include food and drink service. The applicants are also proposing a marquee-style LED sign, which will be programmed to cast a “softer lighting level”and will only change once weekly with updated movie features. With vacation of the existing tenants, all 26 on-site parking spaces will be allocated for theater use.

The property is within a base zoning district of Local Business (LB) which allows principal permitted uses of the General Business District, including theater uses, to operate with a Conditional Use Permit (CUP) pursuant to 17.36.040 of the City Municipal Code. The LB zoning designation also requires a CUP for outdoor restaurant uses. The business will be served by NID water and Nevada City sewer. Only minimal ground disturbance will be necessary, limited to minor paving modifications. The project site is also designated within the City’s Scenic Corridor, applied to land adjacent to roads and highways, whereby the Planning Commission may impose special conditions or design features in consideration of the scenic viewshed.
