Variance - 320 park Avnue
The applicant is proposing to construct a rear-yard deck that will expand an existing rear-deck by 310 square feet. The property is encumbered with a 100-year floodplain as mapped on the Flood Insurance Rate Map (FIRM) and is encumbered with a 100-foot setback from Little Deer Creek, located just outside the rear property boundary.  The deck will be designed so that is an independent structure from the existing deck, and therefore likely avoids the need for special permitting by the Federal Emergency Management Agency (FEMA). However, the 100-foot setback from the Creek is a local standard that can only be reduced with approval of a Variance, pursuant to Section 17.80.120 of the City Municipal Code. As proposed, the new deck is 85 feet from the creek at its closest point.  A Site Plan has been prepared indicating the 100-foot creek setback line and showing the proposed deck footprint along with existing improvements.
